That notice must go to the occupier (such as the property owner, business, or property manager) and/or the independent contractor responsible for snow and ice removal, and it must be served personally or by registered mail. The notice must include the date, time, and location of the incident. Missing this 60-day deadline can bar your claim entirely. There are limited exceptions: the 60-day notice period does not apply to claims involving death, and a court may excuse a missed deadline where there is a reasonable excuse, and the defendant is not prejudiced. Because identifying every responsible party (owner, tenant, snow-removal contractor) takes time, you should speak to a lawyer right away.
If your fall occurred on municipal or government property. Under Ontario’s Municipal Act, you must notify the municipality of the accident, in writing, within 10 days. The notice must include your name, address, and telephone number, along with the time and location of the accident. Failure to provide this notice may result in any action against the municipality being barred.
The general limitation period. Most other personal injury claims, including many slip and fall claims, must be commenced within two years of the date of the injury under Ontario’s Limitations Act. However, the short notice periods above can apply long before that two-year window closes, which is why acting early matters so much.
